この利用規約（以下「本規約」といいます）は、sawada3.com（以下「当方」といいます）が提供する iOS / Android アプリ「にゃんログ」（以下「本アプリ」といいます）の利用に関する条件を定めるものです。本アプリをご利用いただく前に、必ず本規約をお読みください。
第1条（適用）
本規約は、本アプリを利用するすべての方（以下「ユーザー」といいます）に適用されます。本アプリをダウンロード・インストール・利用された時点で、本規約に同意したものとみなします。
第2条（利用環境・アカウント）
- 本アプリは iOS 17.0 以降の iPhone、または Android 8.0 (API 26) 以降の Android デバイスでご利用いただけます
- 本アプリのご利用には、メールアドレスでのサインインまたは Sign in with Apple（iOS のみ）が必要です
- 本アプリの主要機能（記録の保存・同期、AI 機能、家族共有等）はインターネット接続が必要です
- 通信料はユーザーのご負担となります
第3条（禁止事項）
ユーザーは、本アプリの利用に際して以下の行為を行ってはなりません。
- 法令または公序良俗に違反する行為
- 他のユーザーや第三者の権利を侵害する行為
- 本アプリのリバースエンジニアリング、改変、解析、転売
- 本アプリの不具合を意図的に発生させる行為
- 本アプリのサーバーや関連設備に過度な負荷をかける行為
- 当方の業務を妨害する行為
- その他、当方が不適切と判断する行為
第4条（AI 機能について）
気持ち診断機能
- 本機能は 娯楽目的 のものであり、獣医学的・医学的な診断・診療を代替するものではありません
- 愛猫の健康状態に異常を感じた場合は、必ず動物病院・獣医師にご相談ください
- 診断結果の精度は OpenAI が提供する AI モデルの性能に依存し、当方は結果の正確性を保証しません
- 無料プラン：1日あたり 2 回まで / Pro プラン：1日あたり 24 回まで
AI 写真補正機能（Pro 限定）
- 本機能は写真から不要な物体を消去するための AI 機能です（Replicate）
- 結果は写真や指定範囲によって異なり、完全に消去できない場合があります
- 当方は補正結果の品質を保証しません
- 利用上限：Pro プラン 月 10 枚まで（無料プランは利用不可）
第5条（Pro プラン（有料サブスクリプション））
- 本アプリは無料でご利用いただけますが、追加機能（AI 機能の回数増、AI 写真補正、家族共有人数増、猫の登録数増）を含む有料の Pro プランを提供します
- Pro プランの料金は、月額 600 円（税込）です。価格は本アプリ内および各プラットフォーム（App Store / Google Play）にて最新の情報を表示します
- Pro プランは 自動更新サブスクリプション です。購入から 24 時間以上前に解約しない限り、各更新期間の開始時に Apple ID または Google アカウントに課金されます
- 解約方法：iPhone は「設定 → Apple ID → サブスクリプション → にゃんログ Pro 月額 → サブスクリプションをキャンセル」、Android は「Google Play アプリ → アカウント → お支払いと定期購入 → 定期購入 → にゃんログ」から行えます
- 解約後も、すでにお支払い済みの期間中は Pro 機能をご利用いただけます
- すでに経過した期間に対する返金は行われません（App Store / Google Play 各プラットフォームのサブスクリプションポリシーに準じます）
- 料金が改定される場合、本アプリ内またはウェブサイトで事前に通知します。改定後の料金に同意されない場合は解約いただけます
- 家族で共有された猫の記録は、Pro 加入者本人だけでなく、招待されたメンバーも閲覧・編集できます（権限は招待時に設定可能）
第6条（知的財産権）
- 本アプリおよび本アプリに含まれるコンテンツ（プログラム・デザイン・テキスト・画像等）の知的財産権は、当方または正当な権利を有する第三者に帰属します
- ユーザーが本アプリで作成・記録したコンテンツ（写真・テキスト等）の権利はユーザーに帰属します
- ユーザーは、本アプリを私的利用の範囲で使用する権利が付与されます
第7条（サービスの変更・中断・終了）
- 当方は、ユーザーへの事前通知なく、本アプリの内容を変更・追加・削除することができます
- 当方は、システム保守・障害対応・天災等のやむを得ない事由により、本アプリの提供を一時的に中断することができます
- 当方は、本アプリの提供を終了する際には、合理的な期間をもって事前にお知らせいたします
第8条（免責事項）
- 当方は、本アプリの内容について、正確性・有用性・完全性・特定目的への適合性を保証しません
- 当方は、本アプリの利用によりユーザーに生じた損害について、当方に故意または重過失がある場合を除き、責任を負いません
- 本アプリのデータ消失・破損について、当方は責任を負いません。重要なデータは別途バックアップを取ることを推奨します
- 第三者サービス（Supabase、OpenAI、Replicate、RevenueCat、App Store / Google Play 等）に起因する障害について、当方は責任を負いません
第9条（損害賠償の制限）
当方の責任が認められる場合であっても、当方がユーザーに対して負う損害賠償の責任の総額は、本アプリが有料サービスとして提供された場合における直近 1ヶ月分の利用料金を上限とします。本アプリが無料で提供される場合は、損害賠償の義務を負いません。
第10条（規約の変更）
当方は、必要に応じて本規約を変更することがあります。重要な変更がある場合は、本アプリ内またはウェブサイトでお知らせいたします。変更後の規約は、ウェブサイト上に掲載した時点で効力を生じるものとします。
第11条（準拠法・管轄裁判所）
- 本規約の解釈および適用は、日本法に準拠します
- 本アプリの利用に関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします

These Terms of Service (these "Terms") set out the conditions for using the iOS / Android app "nyanlog" (the "App") provided by sawada3.com ("we" or "us"). Please read these Terms carefully before using the App.
Article 1 (Application)
These Terms apply to everyone who uses the App ("users"). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.
Article 2 (Environment & Account)
- The App is available on iPhones running iOS 17.0 or later, or Android devices running Android 8.0 (API 26) or later
- Using the App requires signing in with an email address or with Sign in with Apple (iOS only)
- The App's core features (saving/syncing records, AI features, family sharing, etc.) require an internet connection
- Data communication charges are the user's responsibility
Article 3 (Prohibitions)
When using the App, users must not engage in any of the following acts.
- Acts that violate laws or public order and morals
- Acts that infringe the rights of other users or third parties
- Reverse engineering, modifying, analyzing, or reselling the App
- Intentionally causing malfunctions in the App
- Placing an excessive load on the App's servers or related facilities
- Acts that interfere with our operations
- Any other acts we deem inappropriate
Article 4 (AI Features)
Mood check feature
- This feature is for entertainment purposes and is not a substitute for veterinary or medical diagnosis or treatment
- If you notice anything abnormal about your cat's health, always consult an animal hospital or veterinarian
- The accuracy of results depends on the performance of the AI model provided by OpenAI, and we do not guarantee the accuracy of results
- Free plan: up to 2 times per day / Pro plan: up to 24 times per day
AI photo retouch feature (Pro only)
- This is an AI feature for removing unwanted objects from photos (Replicate)
- Results vary depending on the photo and selected area, and objects may not be completely removed
- We do not guarantee the quality of the retouched results
- Usage limit: Pro plan up to 10 photos per month (not available on the free plan)
Article 5 (Pro Subscription)
- The App is free to use, but we offer a paid Pro plan that includes additional features (more AI check runs, AI photo retouch, more family sharing members, more cat registrations)
- The Pro plan costs 600 yen per month (tax included). The latest pricing is shown within the App and on each platform (App Store / Google Play)
- The Pro plan is an auto-renewing subscription. Unless you cancel at least 24 hours before the renewal, your Apple ID or Google account will be charged at the start of each renewal period
- To cancel: on iPhone, "Settings → Apple ID → Subscriptions → nyanlog Pro Monthly → Cancel Subscription"; on Android, "Google Play app → Account → Payments & subscriptions → Subscriptions → nyanlog"
- After canceling, you can still use Pro features during the period you have already paid for
- No refunds are given for periods that have already elapsed (subject to the subscription policies of each platform, App Store / Google Play)
- If pricing changes, we will notify you in advance within the App or on our website. If you do not agree to the revised pricing, you may cancel
- Records of a shared cat can be viewed and edited not only by the Pro subscriber but also by invited members (permissions can be set at the time of invitation)
Article 6 (Intellectual Property)
- The intellectual property rights to the App and its content (programs, design, text, images, etc.) belong to us or to third parties with legitimate rights
- The rights to content created or recorded by users in the App (photos, text, etc.) belong to the user
- Users are granted the right to use the App within the scope of private use
Article 7 (Service Changes)
- We may change, add to, or remove the App's content without prior notice to users
- We may temporarily suspend the App for unavoidable reasons such as system maintenance, incident response, or natural disasters
- When we discontinue the App, we will notify you in advance with a reasonable period of notice
Article 8 (Disclaimers)
- We do not guarantee the accuracy, usefulness, completeness, or fitness for a particular purpose of the App's content
- Except in cases of our willful misconduct or gross negligence, we are not liable for damages incurred by users through use of the App
- We are not responsible for loss or corruption of the App's data. We recommend backing up important data separately
- We are not responsible for failures caused by third-party services (Supabase, OpenAI, Replicate, RevenueCat, App Store / Google Play, etc.)
Article 9 (Limitation of Liability)
Even where we are found liable, the total amount of damages we owe to a user is limited to the usage fees for the most recent one month during which the App was provided as a paid service. Where the App is provided free of charge, we bear no obligation to pay damages.
Article 10 (Changes to These Terms)
We may change these Terms as necessary. If there are significant changes, we will announce them within the App or on our website. The revised Terms take effect when posted on the website.
Article 11 (Governing Law & Jurisdiction)
- The interpretation and application of these Terms are governed by the laws of Japan
- In the event of a dispute regarding use of the App, the Tokyo District Court shall be the exclusive court of first instance by agreement
